And LJ stay silent, which I can't decide whether is a mistake or not.

I'm waiting for an answer from LJ on this as well. Unless I am mistaken, I believe ponderosa121 embeds the fanart within her LJ using a direct link from her personal website. So it appears that LJ just doesn't want such images on their site, whether it is hosted on their servers or not. Which is all sorts of grey area right now unless LJ comes out and clarifies their stand on this matter.
